تدين الحملة الشعبية لحماية الطفل (مناديل ورق) الحكم الصادر ضد فتيات الاسكندرية ال٢٢ 

القاهرة: 3 ديسمبر 2013.


حيث حكمت محكمة الطفل بايداع القاصرات السبع احدي مؤسسات الرعاية الاجتماعية علي إثر مشاركتهن بوقفة احتجاجية فى منطقة رشدي بسيدي جابر الاسكندرية يوم 31/10/2013 .

وحيث كان في واقعة القبض والاحتجاز ثم المحاكمة العديد من الانتهاكات لحقوق الطفل؛ طبقا للقانون  الطفل المصري رقم 12 لسنة 1996 والمعدل بالقانون رقم 126 لسنة 2008 والذي سن طبقا لاتفاقية حقوق الطفل التي بادرت مصر بالتوقيع عليها من ضمن اول عشرين ٢٠ دولة موقعه.
حيث نصت الاتفاقية:

 المادة 13

“يكون للطفل الحق في حرية التعبير ويشمل هذا الحق حرية طلب جميع أنواع المعلومات والأفكار وتلقيها وإذاعتها، دون أي اعتبار للحدود، سواء بالقول، أو الكتابة أو الطباعة. أو الفن، أو وسيلة أخرى يختارها الطفل.”تم انتهاك حق الفتيات فى التعبير عن رأيهن بالتظاهر السلمي. 

المادة 3

“1.في جميع الإجراءات التي تتعلق بالأطفال، سواء قامت بها مؤسسات الرعاية الاجتماعية العامة أو الخاصة، أو المحاكم أو السلطات الإدارية أو الهيئات التشريعية، يولى الاعتبار الأول لمصالح الطفل الفضلى.
2.تتعهد الدول الأطراف بأن تضمن للطفل الحماية والرعاية اللازمتين لرفاهه, مراعية حقوق وواجبات والديه أو أوصيائه أو غيرهم من الأفراد المسؤولين قانوناً عنه، وتتخذ، تحقيقاًً لهذا الغرض، جميع التدابير التشريعية والإدارية الملائمة.
3.تكفل الدول الأطراف أن تتقيد المؤسسات والإدارات والمرافق المسؤولة عن رعاية أو حماية الأطفال بالمعايير التي وضعتها السلطات المختصة ولاسيما في مجال السلامة والصحة وفي عدد موظفيها وصلاحياتهم للعمل، وكذلك من ناحية كفاءة الإشراف.”
لم تراعي محكمة الطفل المصلحة الفضلي للفتيات كما ينص القانون، بحكمها إيداعهن وتقييد حريتهن ايداعا مفتوح المدة فى احد دور الرعاية، والتي يعد إيداعهن مع القاصرات الجنائيات وغيرهن ممن يعد إيداعهن معهن تعذيبا وتعريضا لهن للخطر، وتدميرا لمستقبلهن الدراسي كطالبات في نفس الوقت، مما يعد انتقاما شرسا لاإنسانيا، يتضارب مع كل القيم والأعراف والقوانين والمباديء.

المادة 37

“3.يعامل كل طفل محروم من حريته بإنسانية واحترام للكرامة المتأصلة في الإنسان، وبطريقة تراعي احتياجات الأشخاص الذين بلغوا سنه. وبوجه خاص، يفضل كل طفل محروم من حريته عن البالغين، ما لم يعتبر أن مصلحة الطفل الفضلى تقتضي خلاف ذلك، ويكون له الحق في البقاء على اتصال مع أسرته عن طريق المراسلات والزيارات، إلا في الظروف الاستثنائية.
4.يكون لكل طفل محروم من حريته الحق في الحصول بسرعة على مساعدة قانونية وغيرها من المساعدة المناسبة. فضلا" عن الحق في الطعن في شرعية حرمانه من الحرية أمام محكمة أو سلطة مختصة مستقلة ومحايدة أخرى، وفي أن يجري البت بسرعة في أي إجراء، من هذا القبيل.”

بعد القبض عليهن تم احتجازهن مع بالغين فى مديرية امن الاسكندرية ولم تكتفي قوات الامن بذلك الانتهاك، بل تم التحقيق معهن فى مديرية امن الاسكندرية، وذلك اكراه للمتهمين والمدافعين عنهم، وانتهاك للعدالة بالتحقيق معهم تحت اشراف القائمين بالضبط.

والجدير بالذكر ان انتهاكات حقوق الاطفال لم تتوقف منذ الموجة الثالثة للثورة فى 30 يونيو بل تزداد سوءا يوما بعد يوم حيث قبض علي اكثر من 400 طفل وطفلة، من مختلف انحاء الجمهورية علي اثر احداث سياسية، وقتل ستة وعشرون طفلا، ولم يتم حتى الآن معاقبة من تسببوا في قتلهم.
وباصدار الرئيس عدلي منصور قانون التظاهر القمعي تزداد مخاوف الحملة من ازدياد الانتهاكات من قتل واحتجاز غير قانوني وقبض عشوائي للاطفال فى ظل تصاعد الاحتجاجات فى جميع انحاء الجمهورية.

تنتظر الحملة الشعبية لحماية الطفل الحكم النهائي علي فتيات ٧ الصبح وتامل فى حكم عادل نزيه غير مسيس حيث انه من الواضح ان تذلك الحكم شابه تدخل سياسي  والحملة ترفض ذلك تماما.

علينا جميعا الحرص علي أبعاد الأطفال عن الصراعات السياسية وعلي الدولة التوقف عن ملاحقة الأطفال والحرص علي رعياتهم ومصلحتهم الفضلي فيما تتاخذه من قرارات.

خط  ساخن وفريق ميداني لحماية الأطفال والقصر (-18) المشاركين في تظاهرات 30 يونيه


في اطار الاستعدادات لتظاهرات 30 يونيه، وبالنظر إلى ما رصدته الحملة الشعبية لحماية الطفل من انتهاكات تعرض لها الأطفال والقصر خلال الفترة الانتقالية وتحت حكم مرسي إلى الحد الذي بلغت معه نسبة الأطفال والقصر المعتقلين إلى 30% من إجمالي عدد المعتقلين منذ احداث ذكري الثورة الثانية.

وبالنظر إلى ما وثقته الحملة بالفيديو من تعرض الاطفال والقصر للتعذيب والاصابة والقتل والاحتجاز مع بالغين بالمخالفة لقانون الطفل من قبل وزارة الداخلية, بالإضافة إلى تعمد وزارة الداخلية اخفاء جثامين الأطفال في بعض الحالات.

لذا، فقد أعدت الحملة الشعبية لحماية الطفل خطة طوارئ تتمثل في النزول بفريق ميداني تم تشكيله من متطوعي الحملة بالإضافة إلى عدد من أخصائيين الجمعيات الأهلية المعنية بالأطفال بهدف حماية الاطفال المعرضين للخطر اثناء التظاهرات وإبعادهم عن اماكن الخطر وتوفير مأوي آمن لهم ورعاية طبية بالإضافة إلى التعاون مع المنظمات الحقوقية المعنية لتقديم المساندة القانونية اللازمة لمن يتم اعتقاله أو يتعرض لانتهاك من أي نوع.

هذا، وتحذر الحملة الشعبية لحماية الطفل وزارة الداخلية وأي جماعات أخرى مسلحة من المساس بالأطفال والقصر واستهدافهم بالاعتقال أو التعذيب أو الاحتجاز في اماكن غير مخصصة للاحتجاز ومع بالغين في مخالفة صارخة لقانون الطفل.

The Case of Omar Salah - April 4, 2013


Barely a couple of months had passed since the death of the child Omar Salah by an Army recruit in the vicinity of the American Embassy in Cairo, a report by the Egyptian Coalition of Children’s Rights (ECCR) confirmed the existence of non-reassuring indicators in the course of the trial. In addition to preventing the ECCR’s solicitors from following the investigations progress, and obscuring the court hearing date (that they knew by coincidence), the court drafted its accusations to the army recruit based on a suspicious forensic report stating that the bullet that killed the martyr child was a non-lethal bullet and not a real one.

Also the Popular Campaign for Protection of Children (Manadeel Waraq) announced its uncertainty regarding military trial procedures. They demanded that ECCR's solicitors and the media be allowed to follow up the course of the trial, which its second hearing is being held on Sunday the 7th of April 2013.

Manadeel Waraq also confirms that the case of the child martyr Omar Salah is neither the first nor the last that government agencies collude to hide violations against children and minors. The campaign has recently spotted a systematic approach to deliberately hide martyrs bodies inside the morgue, whether they are children or adults. The latest incident being a body of a child aged 8-10 yrs old, killed during clashes in Kasr El Nil on the 9th of March 2013 (video link attached).

Manadeel Waraq reiterates its insistence on exposing the violations of various state institutions against children, and to continue to cooperate with all other human rights organisations to prosecute those responsible.

مؤشرات مقلقة في قضية الطفل الشهيد/عمر صلاح

 لم يكد يمض شهران على استشهاد الطفل/عمر صلاح بائع البطاطا علي يد مجند بمحيط السفارة الأمريكية، حتى أفادت متابعات الائتلاف المصري لحقوق الطفل للقضية بوجود مؤشرات غير مطمئنة في سير المحاكمة. فبالإضافة إلى منع محاميي الائتلاف من الاطلاع علي سير التحقيقات والتعتيم على ميعاد انعقاد جلسة المحكمة والذي استطاعوا معرفته بالصدفة البحتة، صاغت المحكمة اتهامها للمجند استنادا على تقرير مريب من الطب الشرعي أفاد بأن الطلقة التي أودت بحياة الطفل الشهيد هي "طلقة فشنك" وليست رصاص حي.
والحملة الشعبية لحماية الطفل إذ تعلن هي الأخرى عن عدم اطمئنانها لسير إجراءات المحاكمة العسكرية، فإنها تطالب بالسماح لمحاميي الائتلاف ووسائل الإعلام بمتابعة سير المحاكمة والتي تنعقد ثاني جلساتها يوم الأحد 7 أبريل 2013.
كما تؤكد الحملة الشعبية لحماية الطفل أن قضية الشهيد/عمر صلاح ليست هي الأولى ولا الأخيرة التي تتواطأ فيها الأجهزة الحكومية لإخفاء انتهاكاتها ضد الأطفال والقصر وأن الحملة قد رصدت مؤخرا توجه ممنهج لتعمد إخفاء جثث الشهداء بالمشرحة سواء كانوا أطفالا أو بالغين، وكان آخر هذه الحالات جثة لطفل يتراوح عمره بين 8-10 سنوات قتل في اشتباكات قصر النيل يوم 9 مارس الماضي (مرفق رابط فيديو الحملة عن الطفل).
هذا، وتكرر الحملة إصرارها على فضح انتهاكات الدولة بمؤسساتها المختلفة ضد الطفل وعلى مواصلتها للتعاون مع كافة المنظمات الحقوقية الأخرى في ملاحقة المسئولين.

Testimonies of 4 Detained Children

1) Testimony of Amira – Mohamed G.’s Sister (16 years old)

The case of Mohamed G. was scheduled for the day before yesterday and she said that no lawyers were present with him during the interrogation, and that’s why his case was postponed indefinitely. Amira spoke of horrendous things that took place in her brother’s story, which includes the fact that he was on his way to AlKasr AlAiny Hospital to undergo surgery in his eye as he had visual problems, and he had with him all the papers and documentation that prove his health condition and his need for the surgery. Unfortunately, he was arrested, in addition to many other children.

Mohamed’s family kept searching for him for a long time until a lawyer called Sayed approached them and told them that Mohamed is at Kasr El Nile Police Station. He took his mother and eldest sister and asked them to pay EGP 200 so he can have him released. However, they refused at the time and wanted Mohamed to be released first. Consequently, Amira says that the lawyer told the Prosecutor that his mother and sister want to kill him, and in subsequence the Prosecutor held both the mother and sister in detention for about an hour until the lawyer left.

Mohamed was beaten, handcuffed, and had children with him that were 6 and 7 years of age.


2) Testimony of Adel M. – 14 years old

Adel was on Kasr El Nile Bridge when he was arrested. He was standing in the middle of the bridge between the protesters and the Central Security Forces. Most of those who were arrested were children, as approximately 28 children were arrested.

Central Security Forces dragged the children on the streets, beat them up, cussed them and slapped them on their faces repeatedly. Adel stood in the street for 2 hours being beaten and he had a laceration in his head.

No one at the police station had him transferred to an ambulance as it was clear that the laceration in his head needed stitches. Adel remained in the police station for 4 hours, bleeding, and they continued hitting him. He was detained for a day at the police station and then he was transferred to Abdeen Prosecution Office, and I don’t know if it was a specialized prosecution for juvenile cases or not. The Prosecution Office had him transferred to Forensic Medicine and no treatment was prescribed for him, despite the clear injury in his head. They then had him transferred to ElKhalifa Police Station where he remained for 2 days with adults. At this police station, they used to open the cell at midnight and hit those detained. As for food, people working in the field of human rights are the ones who  brought food to Adel and others detained, which comprised of bread and cheese, and they are the ones who managed to have food and blankets delivered to those detained. Adel was released with the help of lawyers and we brought his birth certificate.

He was arrested for 4 days and I didn’t know anything about him or where he was detained for more than 24 hours. The next day a Secretary Police Officer allowed the kid to call us and tell us where he was.


3) Testimony of Mohamed F. – 12 yeard old

Mohamed is 12 years old and he was arrested on the 3rd of February 2013. He was accompanied by his friend, and on his way to his aunt at Tahrir square, as she works at the Ministry of Religious Endowments and Islamic Affairs. The soldiers who were dressed in civilian clothes arrested him and his friend on the Corniche, close to Kasr ElNile Bridge. When they were on their way to his aunt, people were running on the bridge and so they started running with them, and when Mohamed fell on the ground they arrested him (and his friend).

When they arrested him they beat him with batons and took him and other children to Kasr ElNile Police Station. They were then deported to the Prosecution Office and then to the Gabal Ahmar Central Security Police Camp, where they beat them, placed them in barrels filled with water, and electrocuted them. His back was filled with burn marks due to electrocution for which he was not treated, and there were obvious bruises and markings of severe beating on his hand and legs, and his hand was so swollen that he couldn’t clench his fist for more than a week, his head was swollen and I took him for treatment when he was released.

The number of children arrested amounted to 25, from which only one was 19 years old, and they were all handcuffed.

He was specifically arrested on Sunday, February 3rd, 2013, and I knew on Monday by sheer coincidence that they had undergone interrogation at the Prosecution Office and stated they they will spend the night at Kasr ElNile Police Station. I went at that time to bring him food and when I returned I found out that they had been deported to Gabal Ahmar Central Security Police Camp. The lawyers there had Mohamed released based on me bring his guarantor and there are other children who were released after having bail set at EGP500.


4) Testimony of Mohamed A. – 17 years old


On January 29, 2013, at 8:00 p.m., in Sayeda Zeinab area in Kasr AlAiny St., Mohamed was purchasing a laser pointer. There was soldiers dressed in civilian clothes in a tourist bus, and one of them asked Mohamed where he was going, and he stated that he was going home, but the soldier replied telling him that he isn’t, and that he was planning on going to the other side with the laser pointer.


How did you know he was arrested? I was calling him at 8:00 p.m. and someone answered his mobile phone telling me that he found it in Tahrir. His sister wanted to go to get his mobile phone, but the man who answered the phone replied: “Come where?! Guns are being fired here” and he hung up.


Mohamed hadn’t returned home until the next day, so I went to look for him in hospitals, police stations and prosecution offices until Saturday (February 2nd), and he was interrogated with during the evening shift of the Prosecution Office, and they informed me after I had submitted a report to the Attorney General. 


The police officer had taken from him his mobile phone and EGP100 and took his ID, and broke it, but there was a police secretary officer who was a good man and said that Mohamed didn’t do anything, and prevented him from getting beaten. They placed him in a van where he spent the night, and they had collected other children who spent the ight in the van as well. They had sprayed pirosol (insecticide) where little children were present, and as a result, several had fainted. They were all very young (25 children) and they had a 15 year-old kid with them, who they had threw from the 2nd floor of some hotel or building after they had chased him, and both his legs were broken. He couldn’t sleep from the pain and when they requested medication for him, the y always replied that there is no treatment or medicine for them. There was also a blind child with them in the van and the Police Officer asked him: “Can’t you see me?”, so the child responded: “I can’t see you”, so the Police Officer told him: “Okay, go inside”, and so the child had slammed himself against the van wall (Most probably this is the child, Mohamed Gomaa Ahmed, who was going to undergo surgery in his eye at Kasr AlAiny Hospital, and I obtained his testimony from his sister).


The children spent the night without food and they kept banging the walls of the van.

Statement by: Egyptian Coalition for the Rights of the Child


Cairo, February 3, 2013 – Statement by:  Egyptian Coalition for the Rights of the Child

Between the Ministy of Interior and the political forces, our children are the victims of political exploitation and violence.  The Egyptian Coalition for the Rights of the Child has been monitoring violations against children in Egypt during the recent events which the country has witnessed in the absence of governmental stability. 


It has been noted, in this report, like others before it, that since the revolution, children have been used and then held fully accountable for the inability of the state and its institutions to find the real culprits behind the events, starting with the events at Institut d'Égypte, The Minitry of of Interior, the People’s Assembly and Mohammed Mahmoud, Abbaseya, and Port Said Stadium massare etc.

During the recent events that took place in different parts of Egypt and around the Presidential Palace since 25 January 2013, the legal unit of the coalition has noted the numerous violations suffered by children; from the initial placement of them in events and the failure of the State to protect them and keep them away from sources of risk to which they may be subjected, which is in accordance to Child Law "1". Instead, they are subjeted to all forms of violence, which amount to torture during their arrest and there is huge difficulty proving these injuries they have suffered for the lack of readiness of forensic reports.


Violations have occurred from arrest to detension for some children who have not yet completed 15 years of age, and decisions to remand them in custody is a violation of the text of the article "119" of the Children's Act, the detention of children with adults, which exposes them to all forms of violations by these adults and are attracting them to the criminal world is in violation of Article "112" of the same law as well as the text of Article 73 of the new constitution!

The Legal Unit also reports that children were presented to the prosecutor after their arrest up to four days later which is in violation of the Code of Criminal Procedure, as well as a number of children presented to the Public Prosecution rather than juvinile prosecutors which is an abuse of the text of the article "122" of the Children's Act !!! Children were sent back and forth between five different public prosecutors located in different places, thereby hindering the right of children to the presence of lawyers specialized in thier defense.


We have filed a complaint to the Attorney General regarding the detention of minors with adults, and not sending them to prosecutors in the legal time limit, this is a criminal offence with a a penalty of up to imprisonment and a fine for each public official committed of the offence. 


At the time of writing this report, the number of child victims has reached 83 children who have the following charges filed against them, such as: "unlawful assembly – distrupting public transportation – assualting civil servants - the use of force and possession weapons and thuggary – intruding on the state institutions - and preventing the course of justice – assaulting and resisting police officers using tools Etc., these are the same accusations that are directed to adults in such events which can not be carried out by children. These are charges which have been prepared. The public prosecutor is ignoring the rights of these children to stand trial before prosecutors and special courts for children or their rights to be granted judicial protection and treatment of children protected by the Egyptian Child Law, which allows the use of clemency and downgrading one or two degrees of the charges in line with being sympathetic to the age and circumstances of the child.

Egyptian Coalition for the Rights of the Child confirms and asks for the following:


• The full refusal of using Egypt’s children in any political events and placing them at the scenes, which is one of the worst forms of exploitation and violence against children and violates the new constitution, which we still oppose and demand that it be amended due to the inability of texts to protect the rights of our children and we take the current events as the greatest example to that.


• The full responsibility of the state, represented in all official institutions for not taking preventative action or an effort to provide protection for the children to keep them away from the source of risk which leads them to participate in the events.


• We call on to the responsibility of the Ministry of Interior for all injuries and violations against our children since their arrest and not to deal with them as criminals acting against the law.


• We appeal for Egyptian society from all walks life, of political and governmental institutions, and non-governmental organisations to work on the immediate cessation of the exploitation of children during the events witnessed by the country's current political situation and to come to a consensus on the mechanisms whereby they can accommodate the angry energies of children in a transitional age of adolescence summoning all efforts to rehabilitate and reintegrate the children into the wider community.
